Aristy, Jeffrey
Bronx, NY

Criminal Sale of a Controlled Substance 2 (4 counts)
Criminal Sale of Firearms 1: 10 or more within one year (2 counts)

Suspect #2 (the 37-year-old male) is in custody with charges pending.

The 61-year-old male bystander was pronounced deceased at Jacobi Hospital at 12:55 a.m. this morning.

Pursuant to an ongoing investigation by the New York City Police Department’s Firearms Investigation Unit into the sale of illegal guns, on Friday, August 28, 2015, an undercover officer was contacted by a suspect who informed the officer that he had guns for sale.  Upon meeting the suspect at a location in the Bronx, Suspect# 1 entered the officer’s vehicle and directed him to drive to Mount Vernon, NY.

The officer parked his vehicle in the vicinity of Beekman Avenue and Tecumseh Avenue when Suspect# 2 entered the back seat.  Suspect# 2 then pointed a gun at the officer’s head while demanding money.  The officer complied and handed Suspect# 2 his money, who then attempted to flee.  After signaling to his backup team, the officer exited his vehicle in order to engage Suspect# 2.

As the officer attempted to stop the suspect, the suspect pointed his gun towards the officer.  The officer discharged his firearm several times striking Suspect# 2 three times in the torso.  During the incident, a 63 year-old male, who was standing behind Suspect# 2, was struck in the torso.

During the course of the investigation, a replica of a large caliber gun was recovered from Suspect# 2, a 37-year-old male, as well as the officer’s buy money.  The 63-year-old male was removed to Jacobi Hospital where he is listed in serious condition and Suspect# 2 was transported to Jacobi Hospital.  The undercover officer was uninjured.  Suspect# 1 fled the scene and the investigation is ongoing.
